Geographic Residency Restriction in Family Law Cases

A geographic restriction is a court imposed limitation on where the child can live. Typically, courts cannot tell grown-ups where they can and can’t live, however, courts can limit the residence of the child. However, if you are the parent of the child and the court limits the residence of that child then your residence has been effectively limited also.

It is the public policy of the State of Texas and as implemented by the Texas Family Code that the non-primary parent shall have frequent and continuing contact with his or her child. Therefore, a geographic restriction is put in place in most cases. The state legislature has said that they want to promote the relationship between both parents and the way to accomplish this is by assuring that there is frequent contact between the parents and child.
