What is a guardianship?
Guardianship is a legal process whereby a court appoints a responsible individual (guardian) to make decisions for another person (ward) who cannot manage their personal, medical, or financial affairs. The Court views a guardianship from two lenses:
- Guardianship of the person involves the appointment of an individual to manage the physical care of a ward, including medical care.
- Guardianship of the estate involves the appointment of an individual to manage the finances and other personal assets of ward.
The court may place both responsibilities with one guardian or separate these roles and appoint different people to carry out each responsibility. With that being said, people who are most likely to receive a guardianship are:
- Elderly individuals who are no longer able to care for themselves
- Disabled adults who do not have legal competency
- Minor children who are unable to be cared for by their parents
The process for becoming a guardian is managed by the probate court in Texas and has several steps. There is a standard review of facts such as letters from medical experts, parental wishes, and any number of pieces of evidence. It is customary for a court-employed investigator to be involved in your case, as well as an attorney ad litem (a local attorney appointed by the Court who has the requisite experience to review these cases).
