The purpose of a Temporary Restraining Order or a Temporary Injunction is to maintain the “status quo” or in other words, keep things the way they are.
Generally, in order to get a Temporary Restraining Order (“TRO”) or a Temporary Injunction one must prove the followings: 1. A cause of action against the Respondent/Defendant; 2. A probable right of recovery at the time of the trial; 3. An irreparable harm to the Petitioner/Plaintiff that is imminent; and 4. No adequate remedy at law.
Several items need to be done before a Temporary Restraining Order or a Temporary Injunction can be granted including, but not limited to, the filing of a verified petition and application.
